Terms of Use

Welcome to The ClubShop. These Terms of Use ("Terms") govern your access to and use of The ClubShop website, mobile application, and all related services (collectively, the "Platform" or "Service"). The Platform is owned and operated by The ClubShop ("we," "us," "our," or "the Company"). By creating an account, accessing, or using the Platform in any way, you agree to be bound by these Terms. If you do not agree, you must not access or use the Platform.

1. Definitions

  • "Buyer" — a registered user who purchases or bids on Items listed on the Platform.
  • "Seller" — a verified football club or authorised club representative that lists Items for sale or auction.
  • "Fan Seller" — a registered user (fan) who lists items on the Fan Marketplace, optionally pledging a donation to a club.
  • "Items" — football-related goods including match-worn kits, training wear, signed memorabilia, stadium fixtures, balls, boots, scarves, and collectibles listed on the Platform.
  • "Listing" — an item made available for sale or auction on the Platform.
  • "Auction" — a time-limited sale where Buyers place bids and the highest bidder wins the right to purchase.
  • "ClubShop Gold" — the premium membership subscription offering enhanced features including proxy bidding, early access, and priority support.
  • "Certificate of Authenticity" or "COA" — a digitally verifiable certificate issued by The ClubShop confirming the authenticity of an Item.
  • "Buyer Protection" — the protection programme covering eligible purchases, funded by the Buyer Protection Fee.
  • "Escrow" — the holding of payment funds by The ClubShop (via Stripe) until transaction conditions are met.
  • "Support Your Club" — the feature allowing Buyers and Fan Sellers to contribute a portion of a transaction to a club's designated fund.

2. The Platform and Our Role

The ClubShop provides an online marketplace facilitating the sale and auction of football-related Items. We act as an intermediary connecting verified football clubs ("Sellers") and fans ("Buyers"), and also operate a Fan Marketplace where supporters can list items and optionally pledge a donation to a club. We are not a party to any transaction between Buyers and Sellers. We do not take ownership of Items and are not responsible for the accuracy of listings, the quality of Items, or the completion of transactions except as expressly provided in these Terms.

3. Eligibility

  • Age Requirement: You must be at least 18 years old to create an account, list Items, make purchases, or place bids on the Platform.
  • Legal Capacity: You must have the legal capacity to enter into binding contracts under the laws of England and Wales.
  • Club Sellers: Only verified football clubs and their authorised representatives are permitted to sell or auction Items as club listings. Clubs must complete the registration and verification process before listings become visible to Buyers.
  • Fan Sellers: Any registered user aged 18 or over may list items on the Fan Marketplace, subject to these Terms.

4. Account Registration and Security

  • You must create an account to use certain features of the Platform, including buying, bidding, listing, messaging, and accessing ClubShop Gold features.
  • You agree to provide accurate, current, and complete information during registration and to update it as necessary.
  • You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
  • You must not share your account with others or use another person's account.
  • You must notify us immediately of any unauthorised use of your account or any other security breach.
  • We reserve the right to suspend or terminate accounts that provide false or misleading information.

5. Club Verification

  • Clubs must complete the registration process, providing club name, contact details, badge, and verification documentation.
  • Newly registered clubs are placed in a "pending approval" status. During this period, clubs may create and save draft listings but cannot publish live listings.
  • Verification can take up to 24 hours. We will contact clubs on the details provided if further information is required.
  • We reserve the right to approve, reject, or revoke verification at our discretion.
  • Verified clubs may publish listings. We may revoke verification if a club breaches these Terms or provides false information.

6. Listings

A. General Listing Rules

  • All Items listed must be genuine football-related memorabilia or goods. Counterfeit or replica items (unless clearly described as such) are prohibited.
  • Sellers are solely responsible for the accuracy of listing descriptions, photographs, condition assessments, pricing, and all other listing details.
  • Sellers must have the legal right to sell the Items they list and must ensure Items are in their possession or available for dispatch.
  • The ClubShop reserves the right to remove any listing that violates these Terms, is misleading, or is otherwise inappropriate.

B. Club Listings

  • Only verified clubs may publish club listings. Items must be authentic club property or authorised for sale by the club.
  • Club listings may include match-worn shirts, signed memorabilia, training wear, stadium fixtures, and other official items.

C. Fan Marketplace Listings

  • Fan Sellers may list football-related items on the Fan Marketplace.
  • Fan Sellers may optionally pledge a percentage of the sale proceeds as a donation to a club of their choice through the "Support Your Club" feature.
  • Fan Sellers are responsible for dispatching items and providing accurate descriptions.

7. Auctions

  • Bidding: Auction bids are binding. By placing a bid, you commit to purchasing the Item at your bid price if you are the highest bidder at auction close.
  • Reserve Price: Sellers may set a hidden reserve price. If the highest bid does not meet the reserve, the Seller is not obligated to sell.
  • Proxy Bidding (ClubShop Gold): Gold members may use proxy bidding, where the system automatically increments their bid up to a specified maximum. The system will bid the minimum amount necessary to maintain the winning position.
  • Buy It Now with Auction: Sellers may offer a Buy It Now price alongside an auction. The first Buyer to pay the Buy It Now price wins the Item and the auction ends immediately.
  • Auto-Relist: Sellers may enable auto-relist for auctions that end without the reserve being met. The listing will be automatically relisted under the same terms.
  • Auction End: The highest bidder at the time the auction ends is obligated to complete the purchase within the payment deadline specified on the Platform.
  • Shill Bidding: Sellers must not bid on their own listings or arrange for others to bid on their behalf. Shill bidding is strictly prohibited and will result in account suspension.

8. Buy Now Purchases

  • Buy Now listings allow Buyers to purchase Items immediately at the listed price.
  • By clicking "Buy Now" and completing checkout, you enter a binding purchase commitment.
  • Payment must be completed through the Platform's checkout process using Stripe.

9. Offers and Counter-Offers

  • Buyers may submit offers on listings where the Seller has enabled offers. Offers must meet the Seller's minimum offer threshold.
  • Sellers may accept, decline, or counter an offer. Counter-offers are valid for the period specified on the Platform.
  • When a Seller accepts an offer, the listing becomes temporarily unavailable to other Buyers, and the Buyer must complete payment within 24 hours. If payment is not received, the listing is reactivated.
  • Accepted offers are binding. Once accepted, the Buyer is obligated to complete the purchase.

10. ClubShop Gold Membership

  • ClubShop Gold is a premium subscription membership offering enhanced features, which may include proxy bidding, early access to listings, priority support, and other benefits.
  • Gold membership is billed on a recurring basis via Stripe. Subscription fees are displayed at the point of subscription.
  • Subscriptions auto-renew unless cancelled. You can cancel your subscription at any time through your account settings or via the Stripe customer portal. Cancellation takes effect at the end of the current billing period.
  • Gold features (including early access listings) are available only while your subscription is active.
  • We reserve the right to modify Gold features, pricing, or availability with reasonable notice. Price changes will take effect at the next renewal.
  • Gold membership fees are non-refundable except where required by law.

11. Support Your Club Donations

  • The "Support Your Club" feature allows Buyers to add a voluntary contribution to a club's designated fund at checkout, and Fan Sellers to pledge a percentage of their sale proceeds to a club.
  • Donations are allocated to the fund selected by the contributor (e.g., First Team, Women's Team, Academy, Community Trust). Clubs may enable, disable, or rename funds.
  • Donations are processed alongside the transaction and held in escrow until the transaction completes. If a transaction is refunded, the associated donation is also refunded.
  • The ClubShop facilitates the transfer of donations to clubs but is not responsible for how clubs use donated funds.
  • Donation amounts are displayed transparently at checkout and in order summaries.

12. Certificates of Authenticity

  • Buyers may request a Certificate of Authenticity (COA) at checkout for an additional fee. COAs are available for eligible club listings.
  • Each COA includes a unique verification code that can be verified through the Platform's verification page.
  • COAs confirm that the Item was sold by a verified club through The ClubShop. They do not constitute a warranty beyond the information stated on the certificate.
  • COAs are issued electronically and may be downloaded as PDF documents from the Platform.

13. Buyer Protection

  • All purchases are covered by The ClubShop Buyer Protection programme. A Buyer Protection Fee is charged on each transaction.
  • Buyer Protection covers eligible disputes including non-receipt of Items, Items significantly not as described, damaged Items, and incorrect Items.
  • To qualify for Buyer Protection, Buyers must raise a dispute through the Platform within 14 days of the estimated delivery date.
  • The Buyer Protection Fee is non-refundable except where The ClubShop determines a full refund is warranted.
  • Buyer Protection does not cover: (a) items where the Buyer simply changes their mind; (b) disputes resolved directly between Buyer and Seller without using the Platform; (c) transactions completed outside the Platform; or (d) damage caused by the Buyer after delivery.

14. Fees, Commissions, and Payments

A. Buyer Fees

  • Buyer Protection Fee: A fee charged on each transaction to fund the Buyer Protection programme.
  • Certificate of Authenticity Fee: An optional fee for requesting a COA at checkout.
  • Shipping Costs: Set by the Seller and displayed at checkout.
  • Support Your Club Donation: An optional voluntary contribution to a club fund.

B. Seller Fees

  • Platform Commission: A commission is charged on each completed sale. The commission rate is displayed to Sellers at the point of listing.
  • Stripe Processing Fees: Payment processing fees charged by Stripe may apply.

C. Payments and Escrow

  • All payments are processed securely via Stripe. We do not store your card details.
  • When a Buyer completes a purchase, payment is held in escrow via Stripe.
  • Seller payouts are released from escrow after the Buyer confirms receipt, or automatically after 14 days if no dispute is raised and the order is marked as delivered.
  • Payouts to Sellers are net of the platform commission and applicable fees.
  • Clubs must complete Stripe Connect onboarding to receive payouts. Fan Sellers receive payouts to their connected Stripe account.
  • The ClubShop reserves the right to update fee structures with reasonable notice. Changes will apply to transactions occurring after the effective date of the change.

15. Shipping and Delivery

  • Sellers are responsible for dispatching Items promptly after payment is confirmed. Items should be dispatched within the timeframe communicated to the Buyer.
  • Shipping costs are set by the Seller and displayed at checkout. The ClubShop uses ShipStation and Royal Mail to support label generation and logistics.
  • Sellers must provide tracking information where available. Tracking numbers are shared with Buyers through the Platform.
  • Risk of loss passes to the Buyer upon delivery to the shipping address provided at checkout.
  • The ClubShop is not responsible for Items lost or damaged in transit. Sellers should use appropriate packaging and tracked shipping services.
  • Buyers must provide an accurate and complete delivery address. The ClubShop is not liable for delivery failures due to incorrect address information provided by the Buyer.

16. Returns and Refunds

  • As this is a marketplace for unique and collectible Items, returns are generally not accepted for change-of-mind reasons unless the Seller offers returns.
  • Buyers may be entitled to a refund where an Item is: (a) not received; (b) significantly not as described; (c) damaged in transit; or (d) incorrect. Such claims must be raised as a dispute within 14 days of delivery.
  • Refunds are processed through the Platform's dispute resolution process. Approved refunds are returned to the original payment method via Stripe.
  • Where a refund is issued, the associated Buyer Protection Fee, COA fee, and donation (if any) are also refunded. The platform commission is reversed.

17. Disputes and Resolution

  • If you have an issue with an order, you must raise a dispute through the Platform within 14 days of the estimated delivery date.
  • When a dispute is raised, the Seller is notified and given an opportunity to respond. Both parties may submit evidence (including photographs) through the Platform.
  • The ClubShop will review the evidence and make a final decision. Decisions may include a full or partial refund to the Buyer, or a finding in favour of the Seller.
  • Disputes may be escalated to The ClubShop support team for further review. Escalated disputes are reviewed by our team and the decision is final.
  • You agree to cooperate in good faith with the dispute resolution process and to be bound by The ClubShop's final decision.
  • The ClubShop reserves the right to issue refunds directly through Stripe where appropriate, including partial refunds for minor issues.

18. Reviews and Ratings

  • Buyers may leave reviews and ratings for clubs after completing a purchase. Reviews must be honest and based on genuine transaction experiences.
  • Clubs may leave reviews for Buyers. Buyer reviews help clubs identify reliable purchasers.
  • Reviews must not contain defamatory, abusive, or false content. The ClubShop reserves the right to remove reviews that violate these Terms.
  • You may not offer or accept payment or incentives in exchange for reviews.

19. Messaging and User Conduct

  • The Platform includes in-app messaging for communication between Buyers and Sellers, and between users and support staff.
  • You must not use messaging to harass, threaten, abuse, or defraud other users.
  • You must not use messaging to circumvent Platform fees by arranging off-platform transactions.
  • The ClubShop may review message content where necessary for dispute resolution, safety, or legal compliance.
  • Clubs may block users from their listings and messaging. Blocked users cannot purchase from or message the blocking club.

20. Prohibited Conduct

You must not:

  • List counterfeit, stolen, or misrepresented Items.
  • Engage in shill bidding, bid manipulation, or any form of auction manipulation.
  • Use automated systems (bots, scrapers) to access the Platform or place bids, except as expressly permitted.
  • Harass, threaten, or defraud other users.
  • Circumvent Platform fees by completing transactions off-platform.
  • Provide false or misleading information in listings, reviews, disputes, or communications.
  • Attempt to gain unauthorised access to the Platform, other users' accounts, or our systems.
  • Use the Platform for any illegal or unauthorised purpose.
  • Reproduce, duplicate, copy, sell, resell, or exploit any portion of the Platform without our express written permission.
  • Interfere with or disrupt the Platform or servers and networks connected to the Platform.

21. Intellectual Property

  • All content on the Platform, including The ClubShop name, logo, design, software, and documentation, is owned by or licensed to The ClubShop and is protected by intellectual property laws.
  • You may not use our intellectual property without prior written consent.
  • Club badges, logos, and names remain the property of the respective clubs. Clubs grant The ClubShop a limited licence to display these on the Platform for the purpose of listings and club profiles.
  • You retain ownership of content you submit (listing photos, descriptions, reviews). By submitting content, you grant The ClubShop a worldwide, non-exclusive, royalty-free licence to use, reproduce, modify, and display that content on the Platform for the purpose of operating the Service.

22. Limitation of Liability

To the fullest extent permitted by law, The ClubShop shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, arising from your access to or use of the Platform. Our total aggregate liability arising from or relating to these Terms or the Platform shall not exceed the amount you have paid to us through the Platform in the six (6) months preceding the event giving rise to the claim, or £100, whichever is greater. Nothing in these Terms shall limit our liability for: (a) death or personal injury caused by our negligence; (b) fraud or fraudulent misrepresentation; or (c) any other liability that cannot be limited or excluded under applicable law.

23. Indemnification

You agree to indemnify, defend, and hold harmless The ClubShop, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from: (a) your breach of these Terms; (b) your use of the Platform; (c) your violation of any law or the rights of any third party; (d) any content you submit; or (e) any transaction you complete through the Platform.

24. Termination

  • We reserve the right to suspend, restrict, or terminate your account at any time, without notice, for breach of these Terms, fraudulent activity, or any conduct we deem harmful to the Platform or its users.
  • You may close your account at any time through the Platform's account deletion feature. Account deletion does not automatically cancel pending transactions or resolve open disputes.
  • Upon termination, your right to use the Platform ceases immediately. Any pending payouts will be processed subject to the completion of any open disputes.
  • Provisions of these Terms that by their nature should survive termination shall continue in effect, including intellectual property, limitation of liability, indemnification, and governing law provisions.

25. Disclaimers

The Platform is provided on an "as is" and "as available" basis. We do not warrant that the Platform will be uninterrupted, error-free, or secure. We do not warrant the authenticity, quality, or accuracy of listings or Items. We are not responsible for the conduct of any user on or off the Platform. You use the Platform at your own risk.

26. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising from or relating to these Terms or the Platform shall be subject to the exclusive jurisdiction of the courts of England and Wales. Nothing in these Terms affects your statutory rights as a consumer under applicable law.

27. Changes to These Terms

We may update these Terms from time to time to reflect changes in our practices, legal requirements, or Platform features. We will notify you of material changes by posting the updated Terms on the Platform and updating the "Effective Date." Your continued use of the Platform after changes are posted constitutes your acceptance of the revised Terms. If you do not agree to the changes, you must stop using the Platform.

28. Consumer Rights

If you are a consumer, nothing in these Terms affects your statutory rights under the Consumer Rights Act 2015 or other applicable consumer protection legislation, which may not be excluded or limited. If you have a complaint, please contact us using the details below. If we cannot resolve your complaint, you may refer it to the Alternative Dispute Resolution (ADR) scheme. As we are based in the UK, you may also contact the Citizens Advice consumer service for guidance.
